How Do I File a Claim?

The first step in filing a workers’ compensation claim in Virginia is to report your injury or illness to your employer in writing immediately after the accident or diagnosis. It is recommended that you retain a copy of this written notice for your own records. Your employer is then required to file a claim with the Virginia Workers' Compensation Commission within 10 days of receiving written notice of the injury.

Your written claim filed with the Commission must include the following information:

  • Your name and address;
  • Your employer's name and address;
  • Date of a) accident or b) communication of occupational disease;
  • Nature of injury or disease;
  • Benefits sought: temporary total, temporary partial, permanent total, permanent partial or medical benefits;
  • Periods of disability, if appropriate.

If your employer disputes your claim, you should notify the Commission and seek the advice of an experienced Richmond work injury attorney. Typically, the Commission will schedule an evidentiary hearing and issue a decision in your case. If you are dissatisfied with the Commission's ruling, you may request a review of the decision by notifying the Commission in writing within 20 days after receipt of the decision.
